TERMS AND CONDITIONS AGREEMENT
This Terms and Conditions Agreement (“Agreement”) governs the relationship between Snow Biscuit Stays (“Homestay,” “Management,” “we,” “our,” or “us”) and any individual or entity (“Guest,” “you,” or “your”) who makes a reservation, booking, or otherwise avails accommodation or services provided by Snow Biscuit Stays. By making a reservation, completing payment, or checking into the premises, you expressly agree to be bound by the following terms and conditions:
1. Booking and Payment
1.1 All reservations are strictly shall be confirmed only upon receipt of 100% advance payment of the total booking amount.
1.2 All bookings are strictly non-refundable, non-transferable, and non-amendable, irrespective of the circumstances, including but not limited to illness, change of travel plans, delays, cancellations, or no-show.
1.3 Rates are exclusive of applicable taxes. Taxes shall be levied as per prevailing government laws at the time of booking.
1.4 The Management reserves the right to cancel or deny accommodation if the full booking amount has not been received in advance.
2. Check-In and Check-Out
2.1 Standard check-in time shall be 12:00 PM, and check-out time shall be 11:00 AM.
2.2 Early check-in or late check-out may be considered solely at the discretion of the Management and may attract additional charges of ₹300/Hr.
2.3 At the time of check-in, all Guests shall provide a valid government-issued photo identification document as required under law.
3. Cancellations and Refunds
3.1 The Guest acknowledges and agrees that all bookings are strictly non-refundable.
3.2 No refund shall be granted in cases of no-show, unused nights, delayed arrivals, early departures or any other reason.
3.3 In the event of natural calamities, force majeure, government-imposed travel restrictions, or any other contingency rendering the reserved property unavailable, on obtaining sufficient evidence the Management may, at its sole discretion:
(a) Provide the Guest with accommodation in an alternative property, subject to availability; or
(b) If the Guest declines such alternative accommodation, issue a non-transferable credit coupon equivalent to the booking amount, valid for a period of two (2) years from the date of issuance, which may be redeemed against any future booking at Snow Biscuit Stays.
3.4 No monetary refund shall be provided under any circumstances.
4. Guest Obligations
4.1 The Guest shall conduct themselves in a decent, orderly, and lawful manner at all times.
4.2 The Guest shall be liable for any loss, damage, or destruction caused to the property, fixtures, furniture, equipment, or any other asset belonging to the Homestay.
4.3 The Guest shall not engage in illegal, disruptive, or immoral activities, including but not limited to substance abuse, gambling, and unlawful gatherings.
4.4 The Management reserves the right to evict any Guest who violates these obligations without refund or compensation.
5. Children and Pets
5.1 Children shall be under the supervision of their parents/guardians at all times, and the Management shall not be responsible for their safety.
5.2 Pets are permitted on the premises only with prior approval of the Management and subject to the following conditions:
(a) Pets are not allowed on beds, sofas, or any furniture.
(b) Guests shall ensure proper hygiene of their pets at all times and shall carry and use a poop scoop or other appropriate waste disposal method. All pet waste must be disposed of in designated areas.
(c) The Guest shall be fully liable for any damage, nuisance, or injury caused by their pet, and the Management reserves the right to impose additional cleaning or repair charges where necessary.
6. House Rules
6.1 Smoking is permitted only in designated areas and strictly prohibited within indoor premises unless otherwise specified.
6.2 Consumption, possession, or distribution of illegal substances is strictly forbidden.
6.3 In Villa Property Quiet hours shall be observed between 10:00 PM and 7:00 AM, during which Guests shall refrain from loud music, noise, or other disturbances.
7. Liability and Indemnity
7.1 The Management shall not be liable for loss, theft, or damage of any personal belongings of the Guest.
7.2 The Management shall not be responsible for injury, illness, accident, or death occurring within the premises or arising from the use of services, amenities, or facilities.
7.3 The Guest hereby agrees to indemnify, defend, and hold harmless the Management, its owners, employees, and affiliates from any claims, damages, losses, or liabilities arising out of the Guest’s stay, conduct, or breach of this Agreement.
8. Force Majeure
The Management shall not be held liable or responsible for failure or delay in performance of its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, weather conditions, strikes, acts of God, epidemics, pandemics, civil disturbances, water/ power supply failure or government restrictions.
9. Privacy and Data Protection
9.1 The Management shall collect and maintain Guest information only for the purpose of reservations, communication, and compliance with statutory requirements.
9.2 The Management shall not share Guest information with third parties except as mandated by law or lawful authorities.
10. Amendment of Terms
The Management reserves the right to amend, revise, or update these Terms and Conditions at any time without prior notice. The revised version shall be deemed effective immediately upon publication on the official website or notification at the Homestay premises.
11. Governing Law and Jurisdiction
11.1 This Agreement shall be governed by and construed in accordance with the laws of India.
11.2 Any dispute, controversy, or claim arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent courts of Dharamshala, Distt Kangra (H.P).
12. Acknowledgement
By confirming a booking, making payment, or occupying the premises of Snow Biscuit Stays, the Guest acknowledges that they have read, understood, and agreed to be legally bound by these Terms and Conditions.
